Rapid Tax, How Investors Can Avoid Hefty Capital Gains Taxes, The 1031 Exchange Solution

 

 

(PRWEB) June 20, 2007 -- Kevin Levine, Vice President of Accommodator Finance Company and a 1031 Exchange Expert, outlines how investors can avoid paying heavy capital gains taxes by engaging in a "like-kind" exchange.

 

Typically, if you exchange investment real estate exclusively for comparable investment real estate, no gain is recognized by the IRS, making the exchange a desirable option for investors eager to keep all of their real estate profits while still keeping their feet wet in the market.

 

For the exchange of a currently owned property with a recently acquired property to be in line with IRC Section 1031, the properties must be of 'like-kind', or similar in nature or character and must be located in the United States. IRS does not specify the quality or grade two properties must have in order to be exchanged. "Whether the real estate is productive, nonproductive, improved or unimproved is not relevant," affirms Levine of Accommodator Finance Company.

 

"The IRS is known to be quite liberal in interpreting what qualifies to be 'like-kind' properties and views virtually all real property as alike in nature or quality," informs Levine. Any combination of apartment buildings, shopping centers, office buildings or stores is permitted.

 

Section 1031 does demand that the status of the currently owned property and the planned use of the investor for the acquired replacement property not be for primary residential use. Additionally, dealer property held for resale, and not for appreciation or income purposes, cannot be exchanged under IRC regulations.
